These Terms and Conditions ("Terms") govern the sale and delivery of container homes ("Products") by High Country Container Homes ("we", "us", "our") to you, the customer ("you", "your"). By placing an order with us, you agree to be bound by these Terms.
1. Quotes and Orders
1.1. All quotes provided by us are valid for a period of 30 days from the date of issue.
1.2. An order is considered confirmed once you have provided written acceptance of our quote and paid the required deposit.
1.3. All orders are subject to acceptance by us. We reserve the right to refuse any order at our discretion.
2. Payment Terms
2.1. A non-refundable deposit of 50% of the total purchase price is required to confirm your order and commence production.
2.2. The remaining balance of 50% is due and payable in full prior to the dispatch and delivery of your Product.
2.3. Payments can be made via direct bank transfer or other methods as agreed upon in writing.
2.4. We reserve the right to charge interest on any overdue amounts at a rate of 2% per month.
3. Delivery
3.1. We currently offer delivery throughout Victoria only. We will deliver the Product to the property address specified in your order within the state of Victoria.
3.2. It is your sole responsibility to ensure that the delivery site is safe, clear, and accessible for a heavy vehicle and crane (if required). You must inform us of any potential access issues, such as narrow roads, gates, overhanging trees, or unlevel ground.
3.3. Any additional costs incurred due to difficult site access or delays caused by you will be charged to you.
3.4. While we will make every effort to deliver on the agreed date, all delivery dates are estimates. We are not liable for any loss or damage incurred by you as a result of any reasonable or unavoidable delay in delivery.
3.5. Our service is limited to the delivery of the Product only. We do not offer the service of erecting, assembling, or installing the container home on your property. The assembly and placement of the home is the sole responsibility of the customer.
4. Title and Risk
4.1. Risk in the Product passes to you upon delivery to your specified property address.
4.2. Title and ownership of the Product do not pass to you until all amounts owing to us have been paid in full.
5. Customer Responsibilities
5.1. Portable Home Classification: Our container homes are designed on a portable base, meaning they are classified as portable homes and generally do not require housing or building regulation permits from local councils. However, regulations may vary between local government areas, and it remains the customer's responsibility to verify any applicable requirements with their local council prior to placement on their property.
5.2. Site Preparation: You are responsible for all site preparation, including but not limited to foundation work (e.g., leveling the site prior to delivery, trenching, and connection of services (water, power, sewerage).
5A. What Is Included and What Is Not
5A.1. Bathroom and kitchen appliances are included with the product as part of your purchase.
5A.2. Air conditioning and heating units are not included. You are responsible for the purchase and installation of your own air conditioning and/or heating systems, which must be carried out by a qualified tradesperson.
5A.3. Plumbing and electrical connections are not included. You are responsible for engaging licensed plumbers and electricians to connect the Product to water, sewerage, and electrical services at your property. All plumbing and electrical work must be carried out by appropriately licensed tradespeople in accordance with Australian standards and local regulations.
6. Cancellations
6.1. If you cancel your order after the deposit has been paid, the deposit is non-refundable.
762. If you cancel your order after production has commenced, you may be liable for additional costs incurred by us up to the date of cancellation.
7. Limitation of Liability
7.1. To the fullest extent permitted by Australian Consumer Law, our liability for any breach of these Terms, or for any loss or damage you may suffer in connection with the purchase and use of our Product, is limited to the purchase price of the Product.
7.2. We are not liable for any indirect or consequential loss, including loss of profit, loss of business, or damage to property.
8. Governing Law
8.1. These Terms are governed by the laws of the state of Victoria, Australia. Both parties agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
